Native Foods Acquisition, LLC (“Native Foods” or “we” or “us”) has adopted this privacy policy (this “Policy”) in order to inform you of its policies with respect to the personal information Native Foods collects, uses, shares, and protects about you through our interactions with you and through our products, services, events, and programs – including the Native Foods mobile application (the “Mobile App”) and our website located at www.nativefoods.kinsta.cloud (the “Website”)(each a “Service,” and collectively, the “Services”).

User Consent: By choosing to interact with Native Foods, including through our Services, as well as by using our platforms, applications, rewards program or communicating with us via email, telephone or in person, you consent to the collection and use of information as described in this Privacy Notice. If you do not consent to the collection, use and/or disclosure of your personal information as set forth in this Privacy Policy, please exit and do not use our Website, Mobile App or other Services.

A. The personal information Native Foods collects and how we use it

We collect personal information from you when you interact with us through the Services. The information we collect may be information that you provide to us directly, such as information that you provide when you visit the Services, or information that is collected from you in a passive or automatic manner, such as information collected from your browser or device. The personal information may identify you directly (e.g., your last name). We also collect information that does not identify you directly, but in certain cases could allow you to be identified indirectly (e.g. certain technical data associated with devices that you use to interact with the Services).

In some instances Native Foods may also collect information from third-party sources that provide, or help us to provide, the Services. As described herein, we use business partners or service providers, such as payment processors and analytics providers, to perform services on our behalf. Some of these partners may have access to information about you that we may or may not otherwise have (for example, where you sign up directly with that provider) and may share some or all of this information with us. We may use this information to administer and improve the Services and to conduct marketing and advertising campaigns.

Paytronix—utilize their system to get information and collect, demographics, frequency, but not make any other decisions based upon the data; collected and used by Paytronix and on their servers; use their platform for marketing and revenue (increase revenue related to marketing)

  • Rewards Program: Native Foods utilizes a third-party service provider, Paytronix, for integration of our loyalty system and to maintain our Rewards Program. Therefore, Paytronix provides certain services which include the maintenance of user accounts that our users or customers set-up. Paytronix may collect and store the information furnished by you, our customers and users, so you can create and use an account or enjoy our Rewards Program and in order to provide related, business support outlined in this Privacy Notice.   • Mobile App: Paytronix has also developed and hosts our Mobile App. Therefore, Paytronix may collect certain data points, such as your mobile device’s geolocation and related information, so we can notify you about a Native Foods in your vicinity, provide you with personalized notifications or emails, push notifications, online or in-app advertising, or other information described in this Privacy Policy.   • Online Ordering: We also use Olo to handle our online ordering and to process payments. In order to process your online order, Olo will collect information necessary to complete the order, including your name and payment information. Should you choose to create an account for any reason, including the ease of online orders, additional personal information may be collected about you, including your first and last name, address, telephone number, and email address. In addition, Native Foods may also collect aggregated data or anonymized data that does not directly identify you.

B. How we share and disclose information

Native Foods does not and will not sell your personal information. We may share information, including Personal Information with affiliated companies, as well as carefully selected business partners and third-party service providers to provide better service to you. We have entered into contracts with all of our third-party service providers that require personal information be kept confidential and prohibit the retention, use, or disclosure of personal information for any purpose other than the services specified. Native Foods does not share or disclose information for commercial purposes without your consent, except as described below:

  • Third-Party Service Providers: As otherwise noted herein, we employ other companies and individuals to perform functions on our behalf. These companies need information about you to perform their service function (such as to process or fulfill your order, verify your credit card information, and to protect you from fraud). We also share certain information, including Personal Information, with chosen companies that help us with marketing functions (such as Paytronix, Olo, and as specified herein). We may engage vendors to place advertisements on our behalf across the Internet and to provide analytics services. These companies may collect certain information from you (e.g. click stream information, browser type, time and date, geolocation, hardware/software information, cookie ID, IP address, etc.) when you visit our Mobile App or Website and use that information to provide advertisements about goods and services that are assumed to be of greater interest to you.
  • Lawful Requests and Safety: We may share your information for any other purpose as disclosed at the time of collection, or when we have otherwise obtained consent. Please note that this Policy is not intended to limit our ability to share or disclose aggregated, or anonymized data. Native Foods also reserves the right to use or disclose information when we believe it is appropriate to comply with the law, it is necessary to protect our interests, to prevent fraud or other illegal activity, and to protect the safety of any person. Nothing in this Privacy Notice is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

You must provide enough information that we can verify who you are and that you are a California resident.  We will only use personal information provided in a request to verify the requester’s identity and authority to make the request.

You also have the right to direct us not to sell your personal information at any time.  To opt out of the sale of your personal information, you may submit a request to us by emailing privacy@nativefoods.com
